What surprises me is just how loud people actually liste to their music, and not just with iPods.

This is another user problem. If it's so loud it hurts, then you probably should turn it down. Not to mention ear-buds are worse for your ears than over the ear headphones when it comes to hearing loss. Apple should ship iPods with Grado headphones. <3.
People who are dumb enough to give themselves hearing loss from listening to music too loudly deserve it. The lawsuit is so ridiculous that guy should be taken out back and shot.
