i think most software patent infringements are pretty bogus. this is because it's not the code that is patented. it's the process that the code entails.
so if you write a program that works in an identical way to a patented program, and you wrote the code all by yourself without looking at the patented code, it's still possible to infringe on the patent.
that said, who knows what microsoft did. maybe they copied code verbatim.

XLM -- I don't entirely get it. is it a voilation of copyright to use someone else's file structures? what a sweet bargaining position to be in. i want to be violated by microsoft.
I heard Microsoft were writing a fix for it by January 11th 2010 and that Microsoft Office 2010 doesn't have the problem.
